Goodside Health SchoolMed Services Authorization

Understanding that your student may need healthcare treatment, behavioral healthcare, or healthcare screenings during school hours while at the school or after hours outside the school, you hereby authorize Goodside Health Medical PLLC DBA Goodside Health, and their respective affiliated entities, collectively the “Entity” or “Goodside Health”, and the School by and through Goodside Health, to initiate and administer such first aid or other medical or behavioral health examination and treatment as may be deemed best under the circumstances, and you hereby consent for your student to receive such care and treatment. If indicated based on clinical findings, you hereby authorize Goodside Health to refer and share your student’s specific protected health or personal information for further evaluation and/or treatment with the appropriate health care provider or entity.  You understand that, due to capacity or other reasons, Goodside Health may not always be available to render such care. By signing below you represent and warrant that you are an authorized legal representative of the student identified herein. You understand that the School will attempt to notify an authorized legal representative of the student in the event of an emergency requiring immediate medical care for your student and if the School is unable to notify an authorized legal representative of the student, it will have your student treated by a duly qualified medical practitioner. You authorize Goodside Health to contact and leave a voicemail and/or a text message, including protected health or personally identifiable information, such as a diagnosis, of you or your student, on the supplied phone number and contact phone numbers previously provided to the School. You also understand the transmission of such personal health and/or personally identifiable information in such a manner may not be secure and may be illegally accessed by a third party. Any medical or demographic information provided to the School may be shared with Goodside Health. Your consent is further given to the School to share any student records of the student related to the medical treatment and/or diagnosis to Goodside Health and you understand that Goodside Health shall share your student’s personally identifiable information such as diagnosis and treatment plans and other demographic information with the School, third-party payors and health plans.  Your authorization regarding disclosure of your student’s personally identifiable health information by Goodside Health to the School, third-party payor and health plans will expire on the ten (10) year anniversary of the date your student is no longer a student of the School, unless earlier revoked by you in writing.

  1. GENERAL CONSENT. By signing this form  you consent for your student to participate in telehealth consultations as well as (when available) in-person health care services to administer first aid or other medical or behavioral health examination and treatment as may be deemed best under the circumstances. Additionally, this consent authorizes medical information about the student, including personally identifiable medical information, to be disclosed to the school District, Goodside Health and medical professionals, administrative staff, third-party payors or health plans, and employees of Goodside Health for the purposes of treatment or general administration. This consent also authorizes the sharing of information containing the student’s personally identifiable medical information for informational purposes by employees of the School or Goodside Health and the use of personally identifiable information by Goodside Health for the development and improvement of software, hardware, and related tools designed to improve services provided by medical professionals, administrative staff, contractors and employees of Goodside Health. This consent further authorizes the disclosure of information, diagnosis, and records containing or related to the student’s personally identifiable medical information for the purposes of billing commercial and insured healthcare payors, state and/or federal healthcare payors, including but not limited to state Medicaid plans. The purpose of such disclosure is to obtain information and/or renumeration for reimbursable medical services. By signing below, you expressly authorize Goodside Health, and any of its contractors, vendors or affiliates to bill Medicaid and any other payors for the specific services performed for your student as outlined in the student’s current Admission, Review and Dismissal/Individualized Education Program (“ARD/IEP”) plan, including under the School Health and Related Services (“SHARS”) program.
  2. ADDITIONAL SERVICES AND OPT-OUT NOTICES.  You hereby consent for your student to participate in age appropriate well-care encounters (“well visits”), examinations for participation in a sport (“sports physicals”), other routine child health and chronic condition screenings (“other screenings”).  The School or Goodside Health will provide your student advanced written notice of upcoming well visits, sports physicals and other screenings (“Notice”).  The Notice will provide you the opportunity to revoke your consent by returning the included opt-out form to the School within the time period specified in the Notice.  Revocations provided by Notice opt-out forms will apply only to the events listed in the Notice and will not serve to revoke your general consent regarding telehealth consultations as well as in-person health care services to administer first aid or other medical or behavioral health examination and treatment for your student, as may be deemed best under the circumstances. 
  3. NO VACCINATIONS OR IMMUNIZATIONS.  By signing this consent you are NOT consenting for your student to receive any vaccination or immunization.  In the event the School or Goodside Health offers vaccinations or immunizations at the School, you will be required to provide additional written consent for your child to participate in such encounters.
  4. RIGHT TO SEEK CARE ELSEWHERE.  Your student’s ability to receive services outside of the school setting will not be impacted. You may withdraw this consent at any time. You understand that you may choose your student’s provider and you have no obligation to select Goodside Health as a healthcare provider for your student. You understand that you are responsible for any out-of-pocket patient responsibility that is not covered by your healthcare payor or other agency. You or your student will have access to all medical information resulting from the telemedicine and in-person health care services as provided by applicable law for patient access to medical records.
  5. NATURE OF TELEHEALTH CONSULTATION. During the telemedicine consultation, the following may occur:
    1. Details of your student’s medical and behavioral health history, examinations, x-rays, and tests may be discussed with other health professionals when medically necessary.
    2. Physical examination and behavioral assessment of your student may take place via a remote medical practitioner through the mobile application, utilizing audio, videos or photos when medically necessary to deliver care. Not all conditions can be treated by a telehealth consultation.
    3. Non-medical personnel including school staff, Goodside Health employees and/or translators may be present to aid with language and technical implementation of the consultation. You authorize school personnel, including the nurses and non-medical personnel, to administer medications to the student, including over the counter medications.
  6. MEDICAL INFORMATION AND RECORDS. All existing laws regarding your access to medical information and copies of your student’s medical records apply to this telehealth consultation and/or in-person heath care service. Additionally, dissemination, beyond the potential uses listed in this consent, of any personally identifiable images or information from this telehealth interaction and/or in-person heath care service will not occur without your explicit consent except you hereby authorize Goodside Health to disclose protected health information about your student to School designees, School nurses, physicians, Goodside Health or other health care providers and payors for treatment, administration and billing purposes. You also authorize Goodside Health to maintain and save your student’s medical records consistent with applicable laws and regulations.
  7. CONFIDENTIALITY. Reasonable and appropriate efforts have been made to mitigate, to the extent possible, the risks associated with the telehealth consultation and/or in-person heath care service, and all existing confidentiality protections under federal and state law apply to information disclosed during this telehealth consultation and/or in-person heath care service.
  8. RIGHTS. You may withhold or withdraw consent to telehealth consultations and/or in-person heath care service, to the disclosure of personally identifiable information to any state or federal agency or other third party, or to any other services at any time. You acknowledge that you have been advised of your right to receive a copy of this authorization as signatory to the authorization.
  9. RISK, CONSEQUENCES AND BENEFITS. You are aware of all potential risks, consequences and benefits of telehealth and/or in-person heath care service. You have had an opportunity to ask questions about this information and all of your questions have been answered to your satisfaction. You understand the written information provided above. You are choosing to enroll in Goodside Health and are not being forced or otherwise unduly influenced to utilize this program.

Notice of Privacy Practices - Goodside Health Affiliated Covered Entity

For purposes of this Notice, when we refer to “you” or “your,” we mean you as a patient or you as the provider of information about a minor patient (“student”).

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOUR STUDENT MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This Notice of Privacy Practices (the “Notice”) describes how Goodside Health Medical PLLC d.b.a Goodside Health, Pediatric Care for Kids PA d.b.a Goodside Healthcollectively the Entity or Goodside Health and the members of its Affiliated Covered Entity (collectively “we” or “our”) may use and disclose your student’s protected health information to carry out treatment, payment or business operations and for other purposes that are permitted or required by law. An Affiliated Covered Entity is a group of health care providers under common ownership or control that designates itself as a single entity for purposes of compliance with the Health Insurance Portability and Accountability Act (“HIPAA”). The members of the Goodside Health Affiliated Covered Entity will share protected health information with each other for the treatment, payment, and health care operations of the Goodside Health Affiliated Covered Entity and as permitted by HIPAA and this Notice of Privacy Practices. For a complete list of the members of the Goodside Health Affiliated Covered Entity, please contact the Goodside Health Privacy Office.

“Protected health information” or “PHI” is information about the student, including demographic information, that may identify the student and that relates to your student’s past, present or future physical health or condition, treatment or payment for health care services. This Notice also describes your rights to access and control your student’s protected health information.

USES AND DISCLOSURES OF PROTECTED HEALTH INFORMATION:

Your student’s protected health information may be used and disclosed by our health care providers, our staff, and others outside of our office that are involved in your student’s care and treatment for the purpose of providing health care services to you student, to support our business operations, to obtain payment for your student’s care, and any other use authorized or required by law.

TREATMENT:

We will use and disclose your  student’s protected health information to provide, coordinate, or manage your  student’s health care and any related services. This includes the coordination or management of your student’s health care with a third party. For example, your student’s protected health information may be provided to a health care provider to whom your student has been referred to ensure the necessary information is accessible to diagnose or treat your student.

PAYMENT:

Your student’s protected health information may be used to bill or obtain payment for your student’s health care services. This may include certain activities that your  health insurance plan may undertake before it approves or pays for your student’s services, such as: making a determination of eligibility or coverage for insurance benefits and reviewing services provided to you student for medical necessity.

HEALTH CARE OPERATIONS:

We may use or disclose, as needed, your student’s protected health information in order to support the business activities of this office. These activities include, but are not limited to, improving quality of care, providing information about treatment alternatives or other health-related benefits and services, development or maintaining and supporting computer systems, legal services, and conducting audits and compliance programs, including fraud, waste and abuse investigations.

USES AND DISCLOSURES THAT DO NOT REQUIRE YOUR AUTHORIZATION

We may use or disclose your student’s protected health information in the following situations without your authorization. These situations include the following uses and disclosures: as required by law; for public health purposes; for health care oversight purposes; for abuse or neglect reporting; pursuant to Food and Drug Administration requirements; in connection with legal proceedings; for law enforcement purposes; to coroners, funeral directors and organ donation agencies; for certain research purposes; for certain criminal activities; for certain military activity and national security purposes; for workers’ compensation reporting; relating to certain inmate reporting; and other required uses and disclosures. Under the law, we must make certain disclosures to you upon your request, and when required by the Secretary of the Department of Health and Human Services to investigate or determine our compliance with the requirements of the Health Insurance Portability and Accountability Act (HIPAA). State laws may further restrict these disclosures.

USES AND DISCLOSURES THAT REQUIRE YOUR AUTHORIZATION:

Other permitted and required uses and disclosures will be made only with your consent, authorization or opportunity to object unless permitted or required by law. Without your authorization, we are expressly prohibited from using or disclosing your student’s protected health information for marketing purposes. We may not sell your student’s protected health information without your authorization. Your student’s protected health information will not be used for fundraising. If you provide us with an authorization for certain uses and disclosures of your student’s information, you may revoke such authorization, at any time, in writing, except to the extent that we have taken an action in reliance on the use or disclosure indicated in the authorization.

YOUR RIGHTS WITH RESPECT TO YOUR STUDENT’S PROTECTED HEALTH INFORMATION:

You have the right to inspect and copy your student’s protected health information.

You may request access to or an amendment of your student’s protected health information.

You have the right to request a restriction on the use or disclosure of your student’s protected health/personal information. Your request must be in writing and state the specific restriction requested and to whom you want the restriction to apply. We are not required to agree to a restriction that you may request, except if the requested restriction is on a disclosure to a health plan for a payment or health care operations purpose regarding a service that has been paid in full out-of-pocket.

You have the right to request to receive confidential communications from us by alternative means or at an alternate location. We will comply with all reasonable requests submitted in writing which specify how or where you wish to receive these communications.

You have the right to request an amendment of your student’s protected health information. If we deny your request for amendment, you have the right to file a statement of disagreement with us. We may prepare a rebuttal to our statement and we will provide you with a copy of any such rebuttal.

You have the right to receive an accounting of certain disclosures of your student’s protected health information that we have made, paper or electronic, except for certain disclosures which were pursuant to an authorization, for purposes of treatment, payment, healthcare operations (unless the information is maintained in an electronic health record); or for certain other purposes.

You have the right to obtain a paper copy of this Notice, upon request, even if you have previously requested its receipt electronically by e-mail.

REVISIONS TO THIS NOTICE:

We reserve the right to revise this Notice and to make the revised Notice effective for protected health information we already have about you student as well as any information we receive in the future. You are entitled to a copy of the Notice currently in effect. Any significant changes to this Notice will be posted on our web site. You then have the right to object or withdraw your consent at any time as provided in this Notice.

BREACH OF HEALTH INFORMATION:

We will notify you if a reportable breach of your student’s unsecured protected health information is discovered. Notification will be made to you no later than sixty (60) days from the breach discovery and will include a brief description of how the breach occurred, the protected health information involved and contact information for you to ask questions.

COMPLAINTS:

Complaints about this Notice or how we handle your student’s protected health information should be directed to our HIPAA Privacy Officer. If you are not satisfied with the manner in which a complaint is handled you may submit a formal complaint to the Department of Health and Human Services, Office for Civil Rights by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting www.hhs.gov/ocr/privacy/hipaa/compliants. We will not retaliate against you or your student for filing a complaint.

We must follow the duties and privacy practices described in this Notice. We will maintain the privacy of your student’s protected health information and to notify affected individuals following a breach of unsecured protected health information. Entendiendo que su estudiante puede necesitar tratamiento de atención médica, atención de salud conductual o exámenes de salud durante las horas escolares mientras se encuentre en la escuela o después de horas fuera de la escuela, por medio de la presente autoriza a Goodside Health Medical PLLC, también conocida como Goodside Health, Pediatric Care for Kids PA, también conocida como Goodside Health, y sus respectivas entidades afiliadas, colectivamente la "Entidad" o "Goodside Health", y a la escuela a través de Goodside Health, a iniciar y administrar primeros auxilios o exámenes médicos o de salud conductual y tratamiento que se consideren los mejores bajo las circunstancias, y por medio de la presente da su consentimiento para que su estudiante reciba dicha atención y tratamiento. Si se indica en base a los hallazgos clínicos, por medio de la presente autoriza a Goodside Health a referir y compartir la información específica protegida de salud o personal de su estudiante para una evaluación y/o tratamiento adicional con el proveedor o entidad de atención médica apropiado. Entiende que, debido a la capacidad u otras razones, Goodside Health no siempre estará disponible para brindar dicha atención. Al firmar a continuación, usted representa y garantiza que es un representante legal autorizado del estudiante identificado aquí. Entiende que la escuela intentará notificar a un representante legal autorizado del estudiante en caso de una emergencia que requiera atención médica inmediata para su estudiante y si la escuela no puede notificar a un representante legal autorizado del estudiante, su estudiante será tratado por un profesional médico debidamente calificado. El Aviso le dará la oportunidad de revocar su consentimiento devolviendo el formulario de renuncia incluido en el Aviso a la Escuela dentro del plazo especificado en el mismo. SIN VACUNAS O INMUNIZACIONES. Al firmar este consentimiento, NO está dando su consentimiento para que su estudiante reciba ninguna vacuna o inmunización. En caso de que la Escuela o Goodside Health ofrezca vacunas o inmunizaciones en la Escuela, se requerirá que proporcione un consentimiento adicional por escrito para que su hijo participe en dichos encuentros.

DERECHO A BUSCAR ATENCIÓN MÉDICA EN OTRO LUGAR. La capacidad de su estudiante para recibir servicios fuera del entorno escolar no se verá afectada. Puede retirar este consentimiento en cualquier momento. Usted entiende que puede elegir al proveedor de atención médica de su estudiante y que no tiene ninguna obligación de seleccionar a Goodside Health como proveedor de atención médica para su estudiante. Usted entiende que es responsable de cualquier responsabilidad económica del paciente que no sea cubierta por su pagador de atención médica u otra agencia. B. La evaluación física y conductual de su estudiante puede tener lugar a través de un médico remoto a través de la aplicación móvil, utilizando audio, videos o fotos cuando sea médicamente necesario para brindar atención. No todas las condiciones pueden ser tratadas por una consulta de telesalud.

C. Personal no médico, incluyendo el personal escolar, los empleados de Goodside Health y/o traductores pueden estar presentes para ayudar con el lenguaje y la implementación técnica de la consulta. Usted autoriza al personal escolar, incluyendo a las enfermeras y al personal no médico, a administrar medicamentos al estudiante, incluyendo medicamentos de venta libre.

INFORMACIÓN Y REGISTROS MÉDICOS. Está optando por inscribirse en Goodside Health y no está siendo obligado o influenciado indebidamente para utilizar este programa.

Este Aviso de Prácticas de Privacidad (el "Aviso") describe cómo Goodside Health Medical PLLC, también conocida como Goodside Health, Pediatric Care for Kids PA, también conocida como Goodside Health, colectivamente la Entidad o Goodside Health y los miembros de su Entidad Cubierta Afiliada (en conjunto, "nosotros" o "nuestro") pueden utilizar y divulgar la información de salud protegida de su estudiante para llevar a cabo tratamiento, pago u operaciones comerciales y para otros fines permitidos o requeridos por la ley. USOS Y DIVULGACIONES DE INFORMACIÓN DE SALUD PROTEGIDA: La información de salud protegida de su estudiante puede ser utilizada y divulgada por nuestros proveedores de atención médica, nuestro personal y otras personas fuera de nuestra oficina que estén involucradas en la atención y tratamiento de su estudiante con el fin de proporcionar servicios de atención médica a su estudiante, para apoyar nuestras operaciones comerciales, para obtener el pago por la atención de su estudiante y cualquier otro uso autorizado o requerido por la ley.

TRATAMIENTO: Utilizaremos y divulgaremos la información de salud protegida de su estudiante para proporcionar, coordinar o administrar la atención médica y cualquier servicio relacionado con su estudiante. Esto incluye la coordinación o administración de la atención médica de su estudiante con un tercero. Por ejemplo, la información de salud protegida de su estudiante puede ser proporcionada a un proveedor de atención médica al que su estudiante haya sido remitido para garantizar que la información necesaria esté disponible para diagnosticar o tratar a su estudiante.

PAGO: La información de salud protegida de su estudiante puede ser utilizada para facturar u obtener el pago por los servicios de atención médica de su estudiante. Esto puede incluir ciertas actividades que su plan de seguro de salud puede llevar a cabo antes de aprobar o pagar por los servicios de su estudiante, como determinar la elegibilidad o la cobertura de los beneficios del seguro y revisar los servicios proporcionados a su estudiante por necesidad médica.

OPERACIONES DE ATENCIÓN MÉDICA: Podemos usar o divulgar, según sea necesario, la información de salud protegida de su estudiante para respaldar las actividades comerciales de esta oficina. Estas actividades incluyen, pero no se limitan a, mejorar la calidad de la atención, proporcionar información sobre alternativas de tratamiento u otros beneficios y servicios relacionados con la salud, desarrollar o mantener y respaldar sistemas informáticos, servicios legales y llevar a cabo auditorías y programas de cumplimiento, incluidas investigaciones de fraude, desperdicio y abuso.


USOS Y DIVULGACIONES QUE NO REQUIEREN SU AUTORIZACIÓN Podemos usar o divulgar la información de salud protegida de su estudiante en las siguientes situaciones sin su autorización. Estas situaciones incluyen los siguientes usos y divulgaciones: según lo requerido por la ley; para fines de salud pública; para fines de supervisión de la atención médica; para informar abuso o negligencia; según los requisitos de la Administración de Alimentos y Medicamentos; en conexión con procedimientos legales; para fines de aplicación de la ley; a médicos forenses, directores de funerarias y agencias de donación de órganos; para ciertos fines de investigación; para ciertas actividades criminales; para ciertas actividades militares y fines de seguridad nacional; para informes de compensación laboral; relacionados con ciertos informes de presos; y otros usos y divulgaciones requeridos. Según la ley, debemos hacer ciertas divulgaciones a pedido suyo, y cuando lo requiera el Secretario del Departamento de Salud y Servicios Humanos para investigar o determinar nuestro cumplimiento con los requisitos de la Ley de Portabilidad y Responsabilidad del Seguro de Salud (HIPAA). Las leyes estatales pueden restringir aún más estas divulgaciones.

USOS Y DIVULGACIONES QUE REQUIEREN SU AUTORIZACIÓN: Otros usos y divulgaciones permitidos y requeridos solo se harán con su consentimiento, autorización u oportunidad para objetar, a menos que lo permita o exija la ley. Sin su autorización, estamos expresamente prohibidos de usar o divulgar la información de salud protegida de su estudiante para fines de marketing. No podemos vender la información de salud protegida de su estudiante sin su autorización. La información de salud protegida de su estudiante no se utilizará para recaudar fondos. Si nos proporciona una autorización para ciertos usos y divulgaciones de la información de su estudiante, puede revocar dicha autorización en cualquier momento, por escrito, excepto en la medida en que hayamos tomado una medida confiando en el uso o divulgación indicada en la autorización.

SUS DERECHOS CON RESPECTO A LA INFORMACIÓN DE SALUD PROTEGIDA DE SU ESTUDIANTE: Tiene el derecho de inspeccionar y copiar la información de salud protegida de su estudiante. Puede solicitar acceso o una enmienda de la información de salud protegida de su estudiante. Tiene derecho a solicitar una restricción sobre el uso o divulgación de la información de salud/personal protegida de su estudiante. Su solicitud debe estar por escrito y especificar la restricción solicitada y a quién desea que se aplique la restricción. No estamos obligados a aceptar una restricción que pueda solicitar, excepto si la restricción solicitada se refiere a una divulgación a un plan de salud para un propósito de pago o de operaciones de atención médica con respecto a un servicio que se haya pagado en su totalidad de su bolsillo.

Tiene derecho a solicitar recibir comunicaciones confidenciales de nuestra parte por medios alternativos o en una ubicación alternativa. Cumpliremos con todas las solicitudes razonables presentadas por escrito que especifiquen cómo o dónde desea recibir estas comunicaciones.

Tiene derecho a solicitar una enmienda de la información de salud protegida de su estudiante. Si denegamos su solicitud de enmienda, tiene derecho a presentar una declaración de desacuerdo con nosotros. Podemos preparar una refutación a nuestra declaración y le proporcionaremos una copia de dicha refutación.

Tiene derecho a recibir un informe de ciertas divulgaciones de la información de salud protegida de su estudiante que hemos realizado, en papel o electrónico, excepto por ciertas divulgaciones que se realizaron con autorización, con fines de tratamiento, pago, operaciones de atención médica (a menos que la información se mantenga en un registro de salud electrónico); o para ciertos otros fines.

Tiene derecho a obtener una copia en papel de esta Notificación, a solicitud suya, incluso si ha solicitado previamente recibirla electrónicamente por correo electrónico.

REVISIONES A ESTA NOTIFICACIÓN:

Nos reservamos el derecho de revisar esta Notificación y hacer que la Notificación revisada sea efectiva para la información de salud protegida que ya tenemos sobre su estudiante, así como cualquier información que recibamos en el futuro. Tiene derecho a una copia de la Notificación actualmente en vigor. Cualquier cambio significativo en esta Notificación se publicará en nuestro sitio web. Entonces tiene derecho a objetar o retirar su consentimiento en cualquier momento según lo dispuesto en esta Notificación.

INCUMPLIMIENTO DE LA INFORMACIÓN DE SALUD:

Le notificaremos si se descubre una violación de la información de salud protegida no segura de su estudiante. La notificación se realizará a usted a más tardar sesenta (60) días después del descubrimiento de la violación e incluirá una breve descripción de cómo ocurrió la violación, la información de salud protegida involucrada y la información de contacto para que pueda hacer preguntas.

QUEJAS: Las quejas sobre esta Notificación o cómo manejamos la información de salud protegida de su estudiante deben dirigirse a nuestro Oficial de Privacidad de HIPAA. Si no está satisfecho con la forma en que se maneja una queja, puede presentar una queja formal al Departamento de Salud y Servicios Humanos, Oficina de Derechos Civiles enviando una carta a 200 Independence Avenue, SW, Washington, DC 20201, llamando al 1-877-696-6775 o visitando www.hhs.gov/ocr/privacy/hipaa/complaints. No tomaremos represalias contra usted o su estudiante por presentar una queja.
